New York Passengers' Rights

Despite improvements in aviation safety and airport security, passengers throughout New York are unsatisfied in general with the state of aviation. Most, if not all, complaints are directed toward large airline companies, their airport representatives and airport staff. Conditions on the aircraft and in the airport have led to an increase in preventable injuries that passengers sustain both on the ground and in the air. If you or someone you love has sustained an aviation-related injury please contact our firm for free legal advice.

Many people are unaware of their rights following an injury causing aviation incident. In most cases that we’ve seen insurance companies, airline staff and others have tried to coerce the victims to sign paperwork or otherwise dismiss charges that they can legally file regarding the incident. Some cases have involved company representatives telling the victim that they are not covered at all. Many of these cases are done on the telephone with no way for the victim to verify if they are true or not.

If some representative is trying to deny your verbal claim you should always get their name, the company they are working for and their direct phone number. In addition you should always ask to have what they are saying put into writing and mailed to you. In many cases this is enough to stop the representatives from lying to you. Before you speak to anyone, however, you should speak to a lawyer from our firm.

An experienced New York aviation lawyer can mean the difference between a victim having to pay thousands of dollars in damages and having these costs paid for them by those responsible. Unfortunately it may take an attorney to have the responsible companies even acknowledge the incident or speak about the victim at all. Our clients have had settlements which have helped pay for medical bills, wrongful death, pain and suffering, physical therapies, loss of work and wages, property damage and many others.

Even non-injurious aviation incidents can be handled by legal representation. Unnecessary aircraft delays often result in the loss of millions of dollars in potential business revenue each year. Schedule changes and mechanical problems are also commonplace. Discrimination, wrongful detention or search and seizure, wrongful refusal to board, failing to assist a disabled passenger, misplaced tickets, fuel shortages, injuries in the airport and others are all common problems that the modern passenger faces unnecessarily.

Because each aviation-related incident is different it is important to consult with an attorney with experience in many diverse types of cases. The New York Aviation Accident Lawyers at Wingate, Russotti & Shapiro have years of experience handling all kinds of incidents.

Our office offers free consultations and works most every aviation case on a contingent basis. This means no fees and you are only charged if we win your case. We can and will begin working on your case as soon as you contact us. We look forward to working for you.
